Skilled Migration

Skilled Migration Visa essentially helps the people who are skilled workers and are willing

to live and work in Australia on permanent basis. It has different categories with some that do not require any sponsor or employer to others where a state, an employer or an Australian relative can sponsor the skilled worker. Skilled Independent – Subclass 189 visa

This is a permanent visa with points-test system for the skilled workers who do not require to be sponsored by an employer or relative and are not nominated by a state or territory government. The candidates are invited to apply through Expression of Interest through Skill Select.

In order to lodge an EOI and ultimately the visa application, the candidate must:

  • Be below 45 years of age at the time of invitation to apply
  • Comply with the minimum English language requirement (Competent English)
  • Have relevant skills and qualifications for an occupation listed on an eligible skilled occupation list called Medium and Long-term Strategic Skills List (MLTSSL)
  • Have a successful skill assessment from the relevant assessing authority
  • Meet the minimum point score for the nominated profession
  • Meet health and character requirements

Since it is a permanent residence visa therefore it allows you and any family members who have also been granted this visa to,

  • Stay in Australia indefinitely with full work, travel and study rights.
  • Apply for Medicare (Australia’s health care scheme)
  • Apply for Australian citizenship (if you are eligible)
  • Sponsor eligible relatives for permanent residence.
  • Travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa to re-enter Australia as a permanent resident.
  • Meet health and character requirements

Skilled Nominated – Subclass 190 visa

This is a points-tested permanent visa available for skilled workers who are nominated by a state or territory government. In order to apply for this visa an EOI is lodged through Skill Select and a nomination is secured through a state or territory government. All state and territory government agencies have their own criteria for deciding who they will nominate. In order to apply for this visa an EOI is lodged through Skill Select and a nomination is secured through a state or territory government. Only after the nomination the candidates are invited to apply for this visa. Once invited, the visa must be lodged within 60 days.

In order to submit an EOI and visa application, you should

  • Have been nominated by an Australian state or territory government
  • Be under 45 years of age at the time of invitation to apply
  • Meet the minimum English language requirement (Competent English)
  • Have skills and qualifications for an occupation listed on an eligible skilled occupation list called STSOL (Short-term Skilled Occupation List)
  • Have a successful relevant skills assessment
  • Meet the minimum points score for relevant profession
  • Meet health and character requirements

With this permanent residence visa, you and your family members who have also been granted this visa can,

  • Stay in Australia indefinitely
  • Work and study in Australia
  • Apply for Medicare (Australia’s health care scheme)
  • Apply for Australian citizenship (if you are eligible)
  • Sponsor eligible relatives for permanent residence
  • Travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa to re-enter Australia as a permanent resident.

Skilled-Recognised Graduate visa (subclass 476)

This is a temporary visa that allows recent engineering graduates to live, work or study in Australia for up to 18 months. In order to apply for this visa an engineering degree or higher qualification must have been completed from a recognised institution within the past two years. All the institutions offering an Engineering qualification with Washington Accord accreditation are considered recognised.

The eligibility criteria for this visa is

  • Be less than 31 years of age
  • Must not have held previously as a primary holder, a Temporary Graduate visa (subclass 485) visa or a Skilled – Recognised Graduate (subclass 476) visa. it can be held as a member of the family unit.
  • Must have specific English language skills (IELTS 6 overall with minimum 5 bands in each component or equivalent scores in TOFEL, PTE, OTE or C1 advanced) or hold a valid passport from the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland.
  • Meet health and character requirements

After you have been granted this visa you and your family members can

  • stay in Australia for usually up to 18 months
  • you can work and study
  • You can apply for permanent residency as you meet the criteria

Skilled Regional (provisional) visa (subclass 489)

This skilled Regional (Provisional) visa is for people, who have the skills, capabilities and experience that are in high demand in regional or low-population growth metropolitan areas of Australia. It is a points-test based skilled visa for people who can be sponsored by an eligible relative living in a designated area of Australia or by an Australian state or territory government.

The visa is divided into three categories:

  • The Invited pathway
  • The Extended Stay pathway
  • The Subsequent Entry pathway

The Invited pathway

To apply for this visa application, the applicant must be

  • invited to apply via Skill Select
  • under 45 years of age at the time of invitation to apply
  • Have skills and qualifications for an occupation listed on relevant skilled occupation list
  • Have been nominated by an Australian state or territory government agency or sponsored by an eligible relative living in a designated area
  • Meet the minimum English language requirement (Competent English)
  • Meet the minimum points score
  • Meet health and character requirements

The Extended Stay pathway

You must currently hold and have never held more than one of the following visas:
Skilled-Independent Regional visa (subclass 495)
Skilled-Regional Sponsored visa (subclass 475)
Skilled-Regional Sponsored visa (subclass 487)
Skilled-Designated Area Sponsored Provisional visa (subclass 496)

If nominated by a state or territory for the current skilled visa, you must be living and working in a regional or low-population growth metropolitan area of the same state or territory. The extended stay pathway for 489 visa allows a further stay of one year to the visa holder.

The Subsequent Entry pathway

This visa is for a member of the family unit of someone who holds a Skilled Regional (Provisional) visa (subclass 489) or a subclass 475, 487, 495 or 496 visas.

Eligible relative who can be a sponsor for the 489 visas if he/she

  • Is at least 18 years of age
  • Lives in a designated area of Australia
  • is an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.
  • Be willing to support applicant and all the included members of the family unit to settle in Australia

The eligible relative must be related to you or your partner as a:

  • Child or stepchild
  • Parent or step-parent
  • Brother, sister, adoptive brother, adoptive sister, step brother, step sister, niece, nephew, adoptive niece, adoptive nephew, step niece, step nephew, aunt, uncle, adoptive aunt, adoptive uncle
  • Grandparent or first cousin

With the help of this visa you can:

  • Stay in Australia for up to four years, with full travel rights
  • Live, work and study in a specified regional area of Australia. This visa provides a pathway to permanent residence through the Skilled Regional visa (Subclass 887)

Skilled Regional – Subclass 887 visa

This is a type of visa which is a permanent visa with no age limit like to hold an eligible visa (like 489, 495, 496, 475, 487 or Bridging visa A or B has created a legitimate application for these visas)

In order to be eligible for this visa, you should:

  • have an eligible visa like 489, 495, 496, 475, 487 or Bridging visa A or B having made a valid application for these visas
  • Must meet residence requirement by having lived for at least 2 years in a regional or low-population growth metropolitan area (if nominated by state or territory government) or a designated area of Australia (if sponsored by a family member) as the holder of an eligible visa
  • Must meet work requirement by having lived and worked full-time (at least 35 hours a week) for at least 12 months in a regional or low-population growth metropolitan area (if nominated by state or territory government) or a designated area of Australia (if sponsored by a family member) as the holder of an eligible visa
  • have complied with the conditions of the eligible visa you hold or have held
  • Must meet health and character requirements

This visa allows you to and any members of the family who have additionally been granted this visa to

  • Stay in Australia indefinitely
  • Work and study in Australia
  • Apply for Medicare (Australia’s health care scheme)
  • Apply for Australian citizenship (if you are eligible)
  • Sponsor eligible relatives for permanent residence
  • Travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa to return to Australia)
