The relationship should not be based on any false intentions of obtaining the citizenship. The proof of genuine relationship plays a vital role in the successful outcome of this visa.

This visa allows the applicant to live, work and study in Australia while the decision is awaited on the permanent visa. The applicant gets multiple entry travel rights and is facilitated by government to enrol in Adult Migrant English language study program.

Partner visa (apply from outside Australia) (Subclasses 309 and 100)

This visa is for the partner or spouse, of an Australian citizen, permanent resident and eligible New Zealand citizen who can sponsor them to live together permanently, from outside Australia. The visa is granted in two stages temporary and permanent. But the application is lodged together and permanent phase follows the temporary phase after two years of successful life together.

In order to be eligible for this visa the applicant has to be in a genuine and continuing relationship with the sponsoring spouse or de facto partner. The visa allows the applicant along with their family members to stay inside Australia with their spouse or partner while their application is being reviewed for permanent residency. It allows them to work and study full time with multiple entry travel rights. The waiting period for the permanent phase can be up to 15 to 24 months at most. Depending upon the circumstances, if the relationship has been a long term then there are prospects of being granted the permanent partner visa (subclass 100) directly instead of temporary visa (subclass 309).

Prospective Marriage visa (Subclass 300)

This visa is for people who are living outside Australia but have a prospect of getting married to an Australian citizen, permanent resident or eligible New Zealand citizen living inside Australia. This visa gives them travel rights to enter into the country and a stay period of 9 months to get married and register their marriage as per the Australian laws.

The applicant has to be above 18 years of age and the prospective partner has to sponsor the applicant. The marriage should take place before the visa becomes invalid. This visa comes with multiple entry rights and a right to live, study and work for 9 months from the date of visa grant. As the provisional period ends the marriage has to take place and application for Partner visa (Subclasses 820 and 801) has to be lodged from within Australia.
